PHILIP provides individual and personal consultancy regarding establishment and implementation of estate planning of companies and other assets. Estate planning is often carried out to ensure the company's survival within the family, which means that the company is transferred to the next generation, or to managing employees or a combination of the two. In connection with estate planning, it is therefore important to assess and analyse who the best candidate for taking over and continuing the company would be.
It is often most expedient to carry out transfer to the next generation while the transferor is still alive, in order for the transferor to have maximum influence on the process, the greatest possible freedom of action and in order to achieve the best possible tax and levy optimisation. Philip provides consultancy in connection with estate planning, and we aim to find the most expedient legal business format. Furthermore, we estimate whether the transfer should be full or successive in order to achieve the most advantageous tax and levy conditions, including optimisation using tax-free company establishment, tax-free division or other tax-free restructuring methods, financing of the estate planning as well as a long line of other issues that depend on the case in question. Apart from estate planning, Philip obviously also provides consultancy within traditional probate law and puts particular emphasis on drawing up testaments that are tailored to the specific client, often combined with prenuptial agreement, aiming for the wishes of the individual client to be met to the widest possible extent. In connection with drawing up of wills, we focus particularly on the fact that it is not just a will that is to be drawn up, but that it is a full service with thorough consultancy ensuring that we have understood our client's wishes and that the client has understood the chosen solution. Throughout the years, Philip has also acquired knowledge and experience within foreign probate law and can also draw on further expertise through its international network, The International Alliance of Law Firms. Philip also has many years of expertise within and knowledge of the administration of the estates of deceased persons - with regard to administration out of court as well as executor administration.
